Alternative Dispute Resolution Services

Mediation Services

In the Mediation Services unit, our neutrals strive to collaborate with all parties to confidentially assess their goals and risk tolerance while offering an unbiased perspective into the outcomes of a given case and ascertain the possibility of bringing about resolution. In this voluntary and consensual process, the third-party neutral seeks a flexible approach to avoid the courtroom and resolve claims while outlining the potential long-term risks of proceeding to trial or a subsequent appeal. Mediation is a process. Our neutrals diligently analyze both the submissions and the related authority in order to provide knowledgeable insight and advice in a manner to reach the best outcome for the respective parties.

Arbitration Services

Where mediation is unsuccessful, our arbitrators offer the opportunity for parties to submit their case to a binding, confidential and expeditious arbitration where the arbitrator or panel of arbitrators preside over an arbitration that allows the parties to set forth their position and submit evidence and testimony, at which point a binding decision is issued. The arbitration process allows for flexibility in the timing, parameters and submissions agreed upon by the parties and gives the parties their “day in court” for a fraction of the cost of trial.

Scott J. Tredwell, Esquire

Mr. Tredwell started his career as the Chief Administrative Law Clerk to the Honorable John T.J. Kelly Jr. in the Superior Court of Pennsylvania. In the following three decades he has specialized in claims brought by or against insurance carriers directly. His practice focuses primarily on bad faith, coverage and first party claims. He has represented insurers in class actions in numerous jurisdictions, including Florida, North Carolina, Texas, West Virginia, Connecticut, Utah and Washington. He has testified as an expert witness and written and lectured frequently on various topics regarding bad faith and related claims by and against insurance carriers. Over the last two decades Mr. Tredwell has served as the editor of a periodic publication Uninsured and Underinsured Motorist Law: A Digest of Reported Cases in Pennsylvania. He has regularly been appointed to serve as a Judge Pro Tempore, and as a neutral arbitrator and mediator in various matters involving insurance law.

Robert J. Cahall, Esquire

Mr. Cahall began his legal career as the law clerk to the Honorable Richard R. Cooch, Resident Judge of the Superior Court of Delaware in and for New Castle County. At McCormick & Priore, Mr. Cahall serves as the chair of the Insurance Bad Faith Litigation Department. He currently focuses his practice in the areas of bad faith litigation, insurance coverage, complex liability litigation, employment litigation, and general casualty litigation. Mr. Cahall also regularly presents seminars on developing authority in the areas of insurance bad faith and insurance coverage in Pennsylvania, New Jersey, and Delaware.

Glen Shikunov, Esquire

Mr. Shikunov is the chair of the firm’s Appellate and Insurance Coverage Unit, focusing his practice in the areas of appellate advocacy, insurance coverage, insurance bad faith, and personal injury litigation. Mr. Shikunov has regularly argued before the Pennsylvania Supreme Court and Superior Court both as appellate counsel and as amicus curiae on behalf of trade organizations and the Pennsylvania Defense Institute. As insurance coverage counsel on behalf of insurers, Mr. Shikunov has litigated numerous declaratory judgment actions focusing on insurance coverage issues, many of which involved matters of first impression. He also regularly presents seminars on novel litigation and appellate issues associated with the insurance industry and serves as a mediator and arbitrator in complex insurance coverage and insurance bad faith cases.
